Internet fraud and theft are an increasing problem, but our policies and proactive and active measures to cooperate with law enforcement and merchant and banking resources ensures you of the most protection that we can give you.  Our policies for other types of fraud are below.

Chargebacks

The ability to place a chargeback on your credit card in the event of fraud is an important protection for consumers who are victims of theft or unauthorized use of their credit cards.  Since we work diligently with law enforcement and banking and merchant institutions to prosecute theft and unauthorized use of credit cards, chargebacks are not necessary.  However,

Legitimate Chargebacks are your protected federal right as a consumer to initiate in examples of the following circumstances:

  • Where someone else makes an unauthorized purchase with your credit card and the merchant does not offer recourse and takes no action.
  • Where you use your card and authorize the purchase but you find you are the victim of a scam website or  illegitimate business.
  • When you do not receive the merchandise you paid for and the merchant takes no action*.
  • When you have returned merchandise and do not receive credit.

In these types of cases, a chargeback is a  tool and a right that protects you from fraud and theft.  Chargeback is not indicated with authorized purchases, merchandise you have received, or legitimate online businesses. *Chargeback is also not indicated for small amounts of credit due, e.g, if you are due $15 it is theft to chargeback a full $700 purchase.  In all such cases and legitimate credit card transactions, the merchant's policies and customer service options apply and you should allow the merchant customer service processes to be utiltized.

Fraudulent Chargebacks and Chargeback Abuse

Chargeback abuse Chargeback abuse occurs when a legitimate customer threatens to initiate a chargeback to steal back their payment without returning the merchandise they paid for.   

Chargeback fraud occurs when a legitimate customer places a chargeback to steal back their payment on merchandise they have received.  Not paying for merchandise you have received, constitutes theft in all US jurisdictions.

Brick and Mortar TestA store may be online, but the laws governing retail sales are the same.  To obtain refund or an exchange item from a 'brick and mortar' store, you must go back to the store and return the merchandise first in the same condition in which it was sold and abide by their return policies.  You can not steal your money back from the cash register.  You should not threaten to steal it back.  The same applies to online retail sales.  If you have the merchandise in your possession, the law says you must pay for it. 

Chargeback abuse policy:

We expect you to abide by the company policies you agreed to follow at the time of your purchase, and use normal merchant customer service processes. We strictly reserve the right to immediately cease all business relations with a customer committing chargeback abuse, including warranty service.  In addition, customers who commit chargeback abuse are reported to multiple national merchant databases of customers who have committed chargeback abuse. This may hamper your ability to do business with other national online businesses.

Chargeback fraud policy:

Violetrcom does not tolerate credit card fraud or theft, and all fraud and theft, including fraudulent chargebacks, without exception, will be prosecuted to the full extent of the law.   In addition, we will pursue civil legal action seeking any loss of income related to the fraud, including business, legal fees, research costs, employee down time and loss of revenues.

Violetrcom considers credit card charge backs to be fraud if you have not returned the merchandise under our return policies and have made no reasonable effort to work with us to resolve any problems with your purchase. All frivolous and fraudulent chargebacks not only cost our employees time away from our usual and customary matters of conducting normal business, but cost us money, therefore:

You agree that if you, the buyer, choose to do business with Violetrcom, and you file a charge back with your credit card company, and you do not win the charge back argument, you agree to pay us $100 for our time responding to the matter.  You, the buyer authorize us to charge this amount to your credit card. If this charge is rejected, Violetrcom will pursue legal action to recoup losses for our time associated with responding to the charge back in addition to any other fees explained above. You agree to reimburse us or any representative we may appoint for any legal expenses your actions may make us incur. We take fraud seriously. If any provision of this Agreement is deemed illegal, invalid, or unenforceable, the remaining provisions shall remain in full force and effect. The waiver of a breach hereunder does not waive any other or subsequent breach.

In the event that you win the charge back with your credit card company, and have not returned our goods, Violetrcom will attempt to recover fraudulently disputed charges plus additional costs via a third-party collection agency and your account will be reported to all credit bureaus as a delinquent collection account. This may severely damage your credit rating for at least the next seven (7) years. At this point, we will no longer accept a return of the merchandise as settlement for the debt and will only accept payment in full. In addition to this, Violetrcom will file a report with your local police or sheriff’s department, and file a mail fraud complaint with the United States Postal Inspection Service.

If you place a chargeback with your credit card company (on purpose or by mistake) for any order that you placed and received through this website, there will be a $100.00 research fee charged to your account upon receiving the chargeback by our merchant provider to cover our investigative expenses to prove that you did make the purchase and did receive the merchandise.

Note: The customer must return any and all merchandise to Violetrcom and allow 30 days for your credit card refund to process before initiating a chargeback.  ALL RETURNS MUST HAVE AN RMA and be covered by our return policies.  To do otherwise constitutes theft of our merchandise.  There are no exceptions.
